How the deadline works

Under CPLR 3122(a), a party served with a document demand under CPLR 3120 must, within 20 days, either produce the requested items or serve a response stating objections with reasonable particularity. Service by mail within New York adds 5 days under CPLR 2103(b)(2); NYSCEF e-service adds none.

A deadline landing on a weekend or court holiday rolls to the next business day. Objections not raised in a timely response may be waived, and a failure to respond can support a motion to compel under CPLR 3124 and sanctions under CPLR 3126.
