How the deadline works

CPLR 4102(a) keys the jury demand to the note of issue rather than to the last pleading directed to the issue — a structural difference from states that run the clock off the pleadings. A party served with a note of issue has 15 days to serve a demand for a jury trial.

Where another party has demanded a jury on some issues only, a separate 10-day window runs to demand a jury on the remaining issues. Service by mail within New York adds 5 days under CPLR 2103(b)(2).
